Impunity in the Activity of the Public Procurement Commission in Albania

This study was prepared by the “Res Publica” Center, with the support of the Open Society Foundation for Albania, as part of the concept: “Challenging the Culture of Impunity.” The study is based on data collected on decision-making during the period from April 2014 to October 2014. The evaluation includes an analysis of the legal framework, data, and other information, primarily gathered from the decision-making of the Public Procurement Commission, as well as data published in reports by international institutions.

The Public Procurement Commission (PPC) is the highest administrative body that reviews administrative complaints from economic operators participating in public procurement procedures. Before cases are brought for review by this commission, complaints are initially presented to the contracting authorities themselves. The PPC’s decisions are administratively final. Interested parties may challenge PPC decisions at the Administrative Court of First Instance in Tirana. One of the important competencies of the PPC is to identify violations by officials working in public procurement, as it is one of the key authorities from which the chain of accountability or even criminal prosecution of responsible persons begins.

The main objective of this study is precisely to assess the effectiveness and integrity of the punitive system and to provide concrete recommendations. This study is the first of its kind and is expected to be followed by others in the future to measure the progress of legal improvement and its implementation.

Pandëshkueshmëria në veprimtarinë e Komisionit të Prokurimit Publik në Shqipëri

Ky studim u përgatit nga Qendra “Res Publica”, me mbështetjen e Fondacionit Shoqëria e Hapur për Shqipërinë, në kuadër të konceptit: “Sfimi i kulturës së pandëshkueshmërisë”. Studimi bazohet në të dhëna të mbledhura mbi vendimmarrjen e periudhës Prill 2014 deri Tetor 2014. Vlerësimi përfshin një analizë të kuadrit ligjor, të dhënave dhe informacioneve të tjera, të mbledhura kryesisht nga vendimmarrja e Komisionit të Prokurimit Publik, si dhe të dhënave të publikuara në raportet e institucioneve ndërkombëtare. Komisioni i Prokurimit Publik (KPP) është organi administrativ më i lartë që shqyrton ankesat administrative të operatorëve ekonomikë, pjesëmarrës në procedurat e prokurimit publik. Përpara se çështjet të dërgohen për shqyrtim në këtë komision, ankesat paraqiten tek vetë autoritetet kontraktore. Vendimmarrja e KPP-së është administrativisht përfundimtare. Palët e interesuara mund të kundërshtojnë vendimet e KPP-së në Gjykatës Administrative të Shkallës së Parë Tiranë. Një nga kompetencat e rëndësishme të KPP-së është konstatimi i shkeljeve të zyrtarëve që punojnë me prokurimet publikë, duke qenë një prej autoriteteve bazë prej nga nis zinxhiri i ndëshkimit të personave përgjegjës apo edhe ndjekjet penale ndaj tyre.

Qëllimi kryesor i këtij studimi është pikërisht vlerësimi i efektivitetit dhe integritetit të sistemit ndëshkues dhe dhënia e rekomandimeve konkrete. Ky studim është i pari i këtij lloji dhe pritet të shoqërohet me të tjerë në të ardhmen për të matur ecurinë e përmirësimit të ligjit dhe zbatimin e tij.
