The Open Society Foundation for Albania presents the Citizen Monitoring Report on the Action Plan for Addressing the 12 Priorities of the European Commission – 2012

Over the past 12 months, efforts and achievements towards fulfilling the 12 European Commission Priorities for Albania have more than doubled compared to the previous year. From 102 measures in 2011, this year state institutions were engaged in implementing 517 measures. The implementation level has risen from 20% in 2011 to 46% by October of this year.

This is the main conclusion of the report published today by the Open Society Foundation for Albania (Soros), which analyzes the progress made in implementing the measures outlined by the Albanian government in the Action Plan for Addressing the European Commission’s Priorities for Albania, approved in March 2012.

Compared to the previous year, the pace of reforms has accelerated. By October 2012:

– 46% of the commitments made have been implemented, compared to only 20% in 2011.

– 32% of the measures are partially implemented, as work has begun but is not yet completed, or because the deadlines are set for the end of the year, leaving time for their implementation.

– In 22% of cases, implementation has not yet started.

Quantitative efforts to address the recommendations have not always translated into impact in some key areas. Specifically, the highest level of plan realization is observed under Priority 1 on the functioning of Parliament, with 80% of measures implemented, although the parliamentary reform itself has not yet been completed. Overall, there has been an increase in the level of implementation in all areas, except one – the fight against organized crime, where implementation dropped from 43% in 2011 to 36% of fully implemented measures in 2012, so far.

Overall, the return of the opposition to parliamentary life has unlocked reforms in key areas, such as Justice and the Fight against Corruption, achieved through changes in the Penal Code, constitutional amendments on immunity, the Law on Administrative Courts, the Judicial Conference, and others. Efforts in other areas requiring consensus have increased, as evidenced by the election of the Ombudsman and the draft law on the High Court. However, they have been insufficient in other key areas, such as the Constitutional Court and the Law on Civil Servant Status.

To build confidence that Albania is on a solid path towards opening membership negotiations, the Foundation recommends prioritizing the following actions for the remainder of 2012:

  1. Completion of Parliamentary Reform
  2. Review of the Law on the High Court
  3. Acceleration of the process of electing the ninth judge for the Constitutional Court to ensure the normal functioning of the court with 9 members
  4. Review of the Law on the Constitutional Court, similar to the Law on the High Court, to set concrete criteria and procedures to be followed by the President of the Republic in appointing judges to the Constitutional Court
  5. Initiation of the debate on constitutional changes for the appointment of judges to the High Court and Constitutional Court, so that our appointment system aligns with the best systems and practices in other European countries
  6. Review of the Law on Civil Servant Status
  7. Finalization and approval of changes to the law on the High Judicial Council (KLD) to definitively resolve the issue of dual inspections

Fondacioni Shoqeria e Hapur per Shqiperine prezanton Raportin Qytetar te Monitorimit te Planit te Veprimit per Adresimin e 12 Prioriteteve te Komisionit Evropian – 2012

Gjatë 12 muajve të fundit, si përpjekjet dhe arritjet për plotësimin e 12 Prioriteteve të Komisionit Evropian për Shqipërinë janë mbi dyfishuar në raport me një vit më parë. Nga 102 masa në vitin 2011, sivjet institucionet shtetërore ishin angazhuar për zbatimin e 517 masave. Nga 20% që ishte niveli i zbatimit në vitin 2011, sivjet, deri në muajin tetor, niveli i zbatimit shënon 46%.

Ky është konkluzioni kryesor i Raportit të Fondacionit Shoqëria e Hapur (Soros) të publikuar sot, i cili analizon progresin e arritur në zbatimin e masave të parashikuara nga qeveria shqiptare në Planin e Veprimit për Adresimin e Prioriteteve të Komisionit Evropian për Shqipërinë, të miratuar në mars 2012.

Në krahasim më një vit më parë, ritmi i reformave është përshpejtuar. Deri në tetor 2012:
– 46% e angazhimeve të ndërmarra janë zbatuar, krahasuar me vetëm 20% në 2011-ën.
– 32% e masave janë pjesërisht të zbatuara, pasi puna për to ka filluar por nuk është përfunduar ende, ose sepse afatet janë përcaktuar deri në fund të vitit, duke lënë rrjedhimisht akoma kohë për zbatimin e tyre.
– Në 22% të rasteve zbatimi nuk ka filluar.

Përpjekjet sasiore në adresimin e rekomandimeve nuk janë përkthyer në imapkt në disa raste kryesore. Konkretisht, niveli më i lartë i realizimit të planit vërehet nën Prioritetin 1 mbi funksionimin e Parlamentit, me 80% masa të zbatuara, ndërkohë që vetë reforma parlamentare nuk është përfudnuar ende. Në tërësi, ka rritje në nivelin e zbatimit në të gjitha fushat, përveç njërës – lufta kundër krimit të organizuar, ku sivjet zbatimi ka rënë nga 43% në 2011, në 36% masa të zbatuara plotësisht në 2012, deri tani.

Në tërësi, rikthimi i opozitës në jetën parlamentare ka zhbllokuar reforma në fusha kyçe, si Drejtësia dhe Lufta kundër Korrupsionit, të arritura përmes ndryshimeve në Kodin Penal, ndryshimeve kushtetuese mbi imunitetin, Ligjit të Gjykatave Administrative, Konferencës Gjyqësore, etj. Përpjekjet në fusha të tjera që varen nga arritja e konsensusit janë rritur, siç dëshmohet nga zgjedhja e Avokatit të Popullit dhe projekt-ligji për Gjykatën e Lartë. Por, ato kanë qenë të pamjaftueshme në fusha të tjera kyçe, si Gjykata Kushtetuese dhe Ligji për Statusin e Nëpunësit Civil.

Që të rrënjosë besimin se Shqipëria është në një rrugë solide drejt hapjes së negociatave për anëtarësim, Fondacioni rekomandon prioritizimin e veprimeve të mëposhtme për pjesën e mbetur të vitit 2012:
1. Përfundimi i Reformës Parlamentare
2. Rishikimi i Ligjit të Gjykatës së Lartë
3. Përshpejtimi i procesit të zgjedhjes së gjyqtarit të nëntë për Gjykatën Kushtetuese, që të sigurohet funksionimi normal i gjykatës me 9 anëtarë
4. Rishikimi i Ligjit për Gjykatën Kushtetuese, në të njëjtën mënyrë si Ligji për Gjykatën e Lartë, për të përcaktuar kritere konkrete dhe proçedurat që duhen ndjekur nga President i Republikës në emërimin e gjyqtarëve të Gjykatës Kushtetuese
5. Hapja e debatit për ndryshime kushtetuese për emërimin e gjyqtarëve të Gjykatës së Lartë dhe asaj Kushtetuese, në mënyrë që sistemi ynë i emërimeve të afrohet me sistemet dhe praktikat më të mira në vendet e tjera evropiane.
6. Rishikimi i Ligjit për Statusin e Nëpunësit Civil
7. Finalizimi dhe miratimi i ndryshimeve në ligjin për KLD në mënyrë që të zgjidhet përfundimisht problemi i inspektimeve të dyfishta
